Abbl Software Terms of Service Policy

These terms and condition (the “Terms and Conditions”) govern the use of abbl.app (the “Site”), other Abbl related sites, communications, content and services (the “Services). By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. If you do not accept all the Terms and Conditions, please do not use our Site or Services.

Abbl Software Pty Ltd trading as Abbl  (referred herein as “Abbl”, “we”, “our” or “us”) is a sales driven Brewery focused ERP designed to help you develop smooth and sensible brewery processed by bringing all of your inventory, production, sales, logistics operations in one easy-to-use platform. 

 

1. Intellectual Property

All content published and made available on our Site is the property of Abbl, this includes by not limited to, images, text, logos, documents, downloadable files, maps, software, code or other material that contributes to the composition of our Site is proprietary to Abbl. Without written permission, no content may be used, copied, reproduced, republished, uploaded, posted, transmitted, distributed or modified in any way. 

 

2. Who can use our Website

By using our Site and Services, users agree that they are over 18 years old. 

By submitting Personal Information for a business entity, you are stating that you represent the entity and have the authority to bind that business entity to our Terms and Conditions and the agreement within our Privacy Policy.

We may use our discretion and limit, suspend or terminate access or use of our Site or Services or accept a user’s Personal Information. Abbl will not assume any legal responsibility for false statements about age or authority to represent business entities. 

 

3. User Conduct and Obligations

When you create an account on our Site or subscribe to our Services, you agree to the following:

  • You are solely responsible for your account and the security and privacy of your account including passwords or sensitive information

  • All Personal Information you provide to us through your account is up to date, accurate, truthful and that you will update your personal information if it changes. 

And you will not:

  • Register, subscribe, unsubscribe or attempt to do so on behalf of a business entity only if they have the authority to do so

  • Harass, mistreat or violate the rights of other users of our Site and Services

  • Act in any way that could be considered illegal, fraudulent, inappropriate or offensive

  • Collect information from, probe, scan or breach our Site or Services

  • Modify, translate, adapt or reverse engineer, disassemble our Site or Services or make any attempt to do so

  • Use our Site or Services in any way that adversely affects the performance of the Site or Services including but not limited to uploading any information that contains viruses, Trojan horses, worms, time bombs or any package designs to damage, interfere, intercept the Site or Software

If you are using our Site and Services on behalf of a business entity, that entity is deemed to be in acceptance of these terms.  

We reserve the right to limit, suspend or terminate your access to our Site and Services if you are using our Site illegally or if you violate these Terms and Conditions.

 

4. Subscription to Services

When subscribing to our Services, you agree that you are authorised to act on behalf of that Business Entity. Your subscription to Abbl’s software will be continually renewed and billed each month until we receive notification that you want to cancel. You may cancel at any time by contacting us in writing.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen and you authorise us to charge the subscription amount.

We reserve the right to increase the subscription amount at any time with written warning.

 

5. Consumer Protection Law

Where the Australia Consumer Law, Schedule 2 of the Competition and Consumer Act 2020 or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is any conflict between these Terms and Conditions and that legislation, that mandatory provisions of the legislation will apply.

These Terms and Conditions are governed by the laws of the State of New South Wales, Australia.

 

5. Limitation of Liability

The information provided on this Site and within our Software is not designed or intended to provide legal, financial or other professional advice. 

 

Abbl Software Pty Ltd and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of our Site or Services. 

Except where prohibited by law, by using our Site and Services, you indemnify and hold harmless Abbl Software Pty Ltd and our directors, officers, agents, employees, subsidiaries and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or Services or your violation of these Terms and Conditions. 

 

6. Changes

This Policy may change from time to time and is available on our website.
